1. Acceptance of Terms

Welcome to Ticcsy. By accessing or using our website and services, you agree to be bound by these Terms and Conditions ("Terms"). If you disagree with any part of these terms, you may not access our services.

2. Description of Services

Ticcsy provides the following services:

  • Link-in-Bio: Customizable landing pages for your social media bio links
  • Storefront: E-commerce integration for creators to sell products and earn commissions
  • AutoDM (Instagram): Automated Instagram direct messaging based on user-configured flows
  • WhatsApp Business Automation: Automated WhatsApp messaging for customer engagement, marketing, and support
  • Analytics: Performance tracking and insights for your content and sales

3. Account Registration

3.1 Eligibility

  • You must be at least 18 years old to use Ticcsy
  • You must provide accurate and complete registration information
  • You are responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activities that occur under your account

3.2 Account Types

Ticcsy offers different account tiers:

  • Starter (Free): 1,000 free AutoDM credits monthly, basic features
  • Pro: $20/month (or $200/year), 50,000 credits + unlimited text messages, advanced features
  • Enterprise: Custom pricing for brands and agencies, dedicated support

4. Instagram Integration

4.1 Authorization

By connecting your Instagram account, you authorize Ticcsy to access and use your Instagram data as described in our Privacy Policy and Meta's Platform Terms.

4.2 Compliance

You agree to:

  • Comply with Instagram's Terms of Use and Community Guidelines
  • Not use AutoDM for spam or prohibited content
  • Not violate Meta's Platform Terms and Policies
  • Use automated messaging responsibly and ethically

4.3 Account Restrictions

We reserve the right to disable your account or AutoDM features if we detect violations of Instagram's policies or abusive behavior.

5. WhatsApp Business Integration

5.1 Authorization

By connecting your WhatsApp Business Account, you authorize Ticcsy to access and use your WhatsApp Business data as described in our Privacy Policy and Meta's WhatsApp Business Platform Terms.

5.2 Compliance

You agree to:

  • Comply with WhatsApp's Business Policy and Commerce Policy
  • Only send messages to customers who have opted in to receive communications
  • Use pre-approved message templates for marketing and utility messages
  • Respond to customer messages within the 24-hour conversation window
  • Not use WhatsApp automation for spam, harassment, or prohibited content
  • Maintain accurate business information in your WhatsApp Business profile

5.3 Message Categories and Billing

WhatsApp messages are categorized and billed as follows:

  • Service Messages (Free): Responses within the 24-hour customer-initiated conversation window
  • Utility Messages: Transaction updates, order confirmations, delivery notifications
  • Marketing Messages: Promotional content, offers, and campaigns (requires opt-in)
  • Authentication Messages: OTPs and verification codes

Message costs vary by recipient country and category. Your WhatsApp Wallet balance will be deducted per message sent. You are responsible for maintaining sufficient balance.

5.4 Account Restrictions

We reserve the right to disable your WhatsApp integration if we detect violations of WhatsApp's policies. Additionally, Meta may restrict or disable your WhatsApp Business Account independent of Ticcsy for policy violations.

5.5 Disclaimers

  • We are not responsible for WhatsApp account restrictions imposed by Meta
  • Message delivery is subject to WhatsApp's infrastructure and policies
  • Template approval is at Meta's discretion and may be rejected or revoked
  • WhatsApp messaging limits are enforced by Meta and may vary based on quality rating

6. Payment and Billing

5.1 Payment Processing

All payments are processed through Razorpay, a PCI-DSS compliant payment gateway. By making a payment, you agree to Razorpay's Terms and Conditions: https://razorpay.com/terms/

  • We do not store your complete credit/debit card information
  • All payment data is encrypted and securely processed by Razorpay
  • We receive only tokenized payment references and transaction confirmations
  • Supported payment methods: Credit/Debit Cards, UPI, Net Banking, Wallets

5.2 Subscription Fees

  • Subscription fees are charged monthly or annually based on your selected plan
  • All fees are final and non-refundable under any circumstances
  • We reserve the right to change pricing with 30 days' notice
  • Failed payments may result in service suspension after 7 days
  • Currency: All prices are in INR (Indian Rupees) unless otherwise stated
  • Your subscription remains active until the end of the paid billing period even if cancelled

6.3 AutoDM Credits (Instagram)

  • Credits are used for non-Storefront promotional AutoDM messages on Instagram
  • Unused credits do not roll over to the next billing period
  • Additional credits can be purchased as needed through Razorpay
  • Credit pricing is transparent and node-based (AI nodes, conditional nodes, etc.)
  • All credit purchases are final and non-refundable

6.4 WhatsApp Wallet

  • WhatsApp messaging uses a separate real-money wallet system
  • Wallet balance is used to pay for WhatsApp messages based on category and recipient country
  • You can top up your wallet at any time using supported payment methods
  • Auto-topup can be configured to automatically add funds when balance is low
  • Wallet balance does not expire while your account is active
  • All wallet top-ups are final and non-refundable
  • Pricing is country-specific and may be subject to change with 30 days notice

5.4 Storefront Commissions and Payouts

  • Creators earn commissions on sales through their Storefront
  • Commission rates are set by brand partnerships
  • Payments are processed as per payout schedule
  • Minimum payout threshold: ₹100 (or as configured)
  • Payout processing time: 3-7 business days
  • Valid bank account details and KYC verification are required for payouts
  • TDS (Tax Deducted at Source) will be applicable as per Indian tax laws
  • Once processed, payouts are final and cannot be reversed

5.5 Taxes

You are responsible for all applicable taxes. Prices may be subject to GST (Goods and Services Tax) or other applicable taxes based on your location. Tax invoices will be provided for all transactions.

6. User Content and Conduct

6.1 Your Content

You retain ownership of content you upload to Ticcsy. By uploading content, you grant us:

  • A worldwide, non-exclusive license to use, display, and distribute your content
  • The right to use your content for service operation and improvement
  • The right to display your content on your public Ticcsy page

6.2 Prohibited Content

You may not upload or share content that:

  • Violates intellectual property rights
  • Contains illegal, harmful, or offensive material
  • Promotes violence, hate speech, or discrimination
  • Contains malware, viruses, or malicious code
  • Violates any applicable laws or regulations

6.3 AutoDM Usage

When using AutoDM, you must not:

  • Send spam or unsolicited messages
  • Harass, threaten, or abuse other users
  • Impersonate others or provide false information
  • Use automation to circumvent Instagram's rate limits
  • Engage in any activity that could result in Instagram account restrictions

7. Intellectual Property

7.1 Ticcsy Property

All Ticcsy branding, logos, designs, and technology are owned by Ticcsy. You may not use our intellectual property without written permission.

7.2 Third-Party Content

You are responsible for ensuring you have the rights to any third-party content (images, music, logos) you use on Ticcsy.

8. Data and Privacy

Your use of Ticcsy is also governed by our Privacy Policy, which explains how we collect, use, and protect your data. By using our services, you consent to our data practices as described in the Privacy Policy.

9. Termination

9.1 By You

You may terminate your account at any time through your account settings or by contacting support.

9.2 By Us

We reserve the right to suspend or terminate your account if:

  • You violate these Terms
  • You engage in fraudulent or illegal activity
  • Your account remains inactive for 12 months
  • We discontinue the service

9.3 Effect of Termination

Upon termination:

  • Your access to services will be immediately revoked
  • Your data will be deleted within 90 days
  • Unpaid earnings will be forfeited
  • You remain liable for any outstanding fees

10. Disclaimers and Limitations of Liability

10.1 Service Availability

Ticcsy is provided "as is" without warranties of any kind. We do not guarantee uninterrupted, error-free, or secure service.

11.2 Limitation of Liability

To the maximum extent permitted by law, Ticcsy shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Loss of profits, data, or business opportunities
  • Damages resulting from Instagram or WhatsApp account restrictions or bans
  • Failed message delivery or template rejections
  • Third-party actions or content

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11.3 Platform Integrations

We are not responsible for changes to Instagram's or WhatsApp's APIs, policies, or platforms that may affect our services. Meta (Instagram/WhatsApp) may restrict or ban accounts for policy violations independent of Ticcsy. Template approvals are at Meta's discretion.

11. Indemnification

You agree to indemnify and hold Ticcsy harmless from any claims, damages, or expenses arising from:

  • Your use of our services
  • Your violation of these Terms
  • Your violation of third-party rights
  • Your content or AutoDM messages

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of [Your Jurisdiction], without regard to conflict of law principles.

12.2 Arbitration

Any disputes shall be resolved through binding arbitration, except for claims that may be brought in small claims court.

13. Changes to Terms

We may modify these Terms at any time. Significant changes will be notified via email or platform notification. Continued use after changes constitutes acceptance.
